(the "Site"). By using the Site or submitting a payment, you agree to be legally bound by these

● Learn more about in-house financing and Buy Here Pay Here (BHPH) options
Use of the Site does not create a binding sales agreement. Any vehicle purchase or financing
must be completed through an executed sales or finance contract.
3. Online Payments & Frazer Pay
We accept secure online payments through Frazer Pay. By using this feature, you agree to the
terms of Frazer Pay and authorize us to process the payment for the stated purpose.
All payments are final and non-refundable, except where required by law or where a specific
written agreement is in place.
4. Vehicle Sales – Final and “As-Is”
Unless otherwise stated in writing, all vehicles are sold “AS-IS” with no warranties, express or
implied.
By completing a purchase or placing a deposit, you agree that:
● You’ve had the opportunity to inspect the vehicle or waive that right
● The sale is final
● No refunds or exchanges are allowed once the vehicle is delivered or paperwork is
signed
5. Buy Here Pay Here (BHPH) Terms
If you enter a BHPH financing agreement:
● You are responsible for making timely payments
● Late payments may result in late fees, repossession, or disabling of the vehicle (if
applicable)
● Full insurance coverage is required for the term of your agreement
● Payment history may be reported to credit bureaus
Details will be governed by your written Retail Installment Contract.
6. Non-Dispute / Chargeback Waiver
By submitting payment on this site, you agree not to initiate a chargeback, reversal, or dispute
with your credit card company or bank unless there is a verified case of fraud.
All concerns must first be brought to our attention.
Unauthorized chargebacks may be considered fraud and may result in legal action to recover
costs.
7. Intellectual Property
All content on this Site, including photos, vehicle descriptions, logos, and layout, is the property
of The Car Shop or its licensors. Unauthorized use or reproduction is prohibited.
8. Disclaimer of Accuracy
Vehicle listings, descriptions, pricing, and financing details are believed accurate but are not
guaranteed. Inventory and pricing are subject to change without notice.
9. Limitation of Liability
We are not liable for any damages, losses, or issues arising from use of this Site, including but
not limited to errors in listings, payment processing issues, or misuse of provided information.
10. Governing Law
These Terms are governed by the laws of the State of West Virginia. All disputes shall be
resolved in the courts of Cabell County, West Virginia.
